New York is a “BUYER BEWARE” state. Through the legal maxim
of Caveat Emptor, the NYS courts hold prospective real estate buyers responsible
for verifying information about a property and a home. This includes taxes,
square footage, heating costs, neighborhood issues, and the structural
integrity of the house. The law, which limits the seller’s liability
and legal recourse due to non-disclosure, means that if something should
go wrong after the home purchase, the buyer is financially responsible.
